Flugpreiserstattungen mit Hilfe des Department of Transportation (DOT)

Bei uns nicht so ganz bekannt sind die US Verbraucherschutzrechte. Hier wacht mit eiserner Faust das Department of Transportation darüber. Ganz spannend ist das für US Flüge. Liegt das Ziel der Reise in den USA, dann ist dieser Flug durch das DOT geschützt. Ein Fall beim Department of Transportation ist sehr einfach einzureichen. Normalerweise reagieren Airlines bei Zurechtweisungen des Department of Transportation sehr schnell und kundenfreundlich. Die DOT Strafzahlungen sind horrend und da wirkt meistens schon der Zeigefinger eines DOT Beamten.

Wichtig ist allerdings, dass du es schriftlich von der Airline hast, dass dir nur ein Gutschein gewährt wird. Wenn nicht, dann rufe nochmals an und drohe mit dem DOT. Zumindest brauchst du etwas Schriftliches von denen, das bei der Einreichung angefügt werden muss.

Mir ging es mit der Alaska Airlines so. Im März mussten wir zwei direkt gebuchte Inlandsflüge aufgrund Corona stornieren. Dafür bekam ich zwei Gutscheine, die bis Mitte nächsten Jahres zur Buchung einlösbar wären. Unsere Route hat sich aber geändert und wir haben aber keine Inlandsflüge mehr geplant. Die Airline war Mitte April auf einmal telefonisch (wahrscheinlich wegen Überlastung) nicht mehr erreichbar. Aufgrund dessen hatte ich das Formular beim DOT eingereicht.

Nach genau 14 Tagen meldete sich das DOT bei mir [img]http://www.smilies.4-user.de/include/Froehlich/smilie_happy_133.gif[/img]. Hier die Antwort:

Ich war gespannt, ob und wie die Alaska Airlines darauf reagiert.

Nachdem sich der Alaska-Airlines Kundenservice so gar nicht rührte, hatte ich die Hoffnung schon aufgegeben, doch vorgestern erhielt ich diese Mail :smilie_winke_048::

Upon review of your itinerary, we noted that you went to our website to cancel your itinerary and did not contact us to inquire about a refund (until we received your U.S. Department of Transportation complaint). Per our policy, our call center staff is consistently complying with the Department's refund guidance in that we will offer a refund when one is due. In cases in which we significantly change or cancel a flight, a refund will be offered. As explained above, you canceled via our website and accepted the credits at that time.

That said, your tickets did qualify for refunds and, as a result, we submitted a refund request on your behalf (in lieu of the credits you were previously offered). That refund was paid out on June 20, 2020. I apologize for any inconvenience you may have been caused.

Alles Ausreden, damit sie vor dem DOT gut dastehen. Die waren zwei Wochen lang telefonisch nicht erreichbar und mein Meilenkonto löschten sie in der Zeit klammheimlich. Aber auf die paar mickrigen Meilen kommt es mir nicht an.

Jedenfalls wurden beide Tickets komplett erstattet und das Geld ist auf dem KK-Konto :Freude 01:.
